CPD guide

You can do Mental Capacity Act training online in the UK with Lift College. Mental Capacity Act Training is 2 hours of learning in 6 short modules, written for care, support and health workers in England and Wales, where the Act applies, with the separate law in Scotland and Northern Ireland explained. It costs £19.99 pay once, gives you a CPD certificate issued by Lift College the same day you pass, and comes with a free refresher every 3 years. Employers and inspectors look for a certificate that records the course, hours, completion date and refresh date, and Lift College's certificate shows each of these.

What employers look for in an online Mental Capacity Act certificate

Your employer decides what Mental Capacity Act training you need, based on your role. The Act's Code of Practice says anyone working with or caring for an adult who may lack capacity must have regard to it, and the Care Quality Commission checks that staff understand consent, capacity and best interests. When an employer checks a certificate, they usually look for:

  • Content that follows the Act and its Code of Practice. The five principles in section 1, the two stage test of capacity, best interests, restraint and the Deprivation of Liberty Safeguards.
  • A clear, verifiable record. The course name, hours of learning and completion date, with a way to confirm the certificate.
  • The essentials every care worker needs. Assuming capacity, supporting decisions, when and how to assess, recording a best interests decision, lawful restraint, and when a deprivation of liberty needs authorising.
  • A refresh date. The Act is applied in daily care decisions and the law on deprivation of liberty is changing, so employers expect a refresh date.

Lift College's certificate does each of these. It records Mental Capacity Act Training, 2 hours of learning, your completion date and a recommended refresh date 3 years on, with a unique certificate number and a verification link. Awareness training gives every care worker the principles. Staff who carry out formal capacity assessments or act as best interests assessors need further training that their employer arranges.

What the Lift College course covers

There are 6 short modules, each with a knowledge check, then a multiple choice final test with an 80% pass mark and unlimited free retakes.

  1. The five principles. Assume capacity, support decision making, the right to make an unwise decision, best interests, and the least restrictive option.
  2. Assessing capacity. Decision and time specific, the test of understanding, retaining, using or weighing and communicating, and how to record it.
  3. Best interests. The checklist, involving the person and the people who know them, and recording the decision.
  4. Care, treatment and restraint. Acts in connection with care and treatment, and when restraint is lawful because it is necessary and proportionate.
  5. Planning ahead. Lasting powers of attorney, deputies, advance decisions to refuse treatment and independent mental capacity advocates.
  6. Deprivation of liberty. What counts as a deprivation of liberty, the Deprivation of Liberty Safeguards, and the planned Liberty Protection Safeguards.

By the end you can apply the five principles to everyday decisions, recognise when a capacity assessment is needed and what it involves, contribute to and record a best interests decision, understand when restraint is lawful, and know when to raise a possible deprivation of liberty.

The law and guidance it is written around

  • Mental Capacity Act 2005, section 1 (England and Wales). The five principles: a person is assumed to have capacity; they must be helped to decide before being treated as unable to; an unwise decision does not mean they lack capacity; anything done for a person who lacks capacity must be in their best interests; and the least restrictive option must be considered.
  • Mental Capacity Act 2005, sections 2 to 6 and Schedule A1 (England and Wales). The test of capacity, best interests, acts in connection with care and treatment, the limits on restraint, and the Deprivation of Liberty Safeguards for care homes and hospitals.
  • Adults with Incapacity (Scotland) Act 2000 (Scotland). Scotland has its own law on decisions for adults who lack capacity. This course is written for England and Wales.
  • Mental Capacity Act (Northern Ireland) 2016 (Northern Ireland). Northern Ireland has its own Act, which is being brought into force in stages.

The Liberty Protection Safeguards, passed by Parliament to replace the Deprivation of Liberty Safeguards, have not been brought into force. The course explains what is in force now and what is planned.

Who it suits

Mental Capacity Act Training is for anyone who cares for or supports adults who may lack capacity to make some decisions, in England and Wales. It is for you if:

  • you work in a care home, supported living, home care or a hospital
  • you support people living with dementia, a learning disability or a brain injury
  • you are involved in decisions about people's care
  • your employer has asked you to complete Mental Capacity Act training
  • you want to be confident about consent and best interests

If you work in Scotland or Northern Ireland, the principles are similar but the law is different, and your employer will point you to training on the Adults with Incapacity (Scotland) Act 2000 or the Mental Capacity Act (Northern Ireland) 2016.

The Act works alongside safeguarding: see our safeguarding adults level 2 guide. Many capacity questions arise for people living with dementia, covered in our dementia awareness guide, and consent to medicines is in our medication awareness guide. Frequently asked questions

Which online Mental Capacity Act certificate do UK employers accept?
Your employer decides, based on your role and the Care Quality Commission's expectation that staff understand consent, capacity and best interests. Look for a certificate that records the course, hours, completion date and refresh date and can be verified. Lift College's certificate shows all of these, with a unique number and a verification link your employer or inspector can use.
Is online Mental Capacity Act training valid?
Yes. The Act and its Code of Practice do not prescribe a form of training, and online awareness training is how most care providers give every member of staff the principles. Staff who carry out formal capacity assessments, act as best interests assessors or sign Deprivation of Liberty Safeguards paperwork need further training on top, which this course points you towards.
How often should Mental Capacity Act training be refreshed?
The law does not set a fixed interval. Most care providers put the Act in their mandatory training cycle and refresh every one to three years, and inspectors ask when staff were last trained. Lift College recommends refreshing every 3 years, and the refresher is free. Refresh sooner when the Liberty Protection Safeguards come into force or your role changes.
What are the five principles of the Mental Capacity Act?
A person must be assumed to have capacity unless it is established that they lack it. They must be given all practicable help to decide before anyone treats them as unable to. An unwise decision does not mean they lack capacity. Anything done for a person who lacks capacity must be in their best interests. It must be the least restrictive option. The course applies each to daily care.
Does the course cover the Deprivation of Liberty Safeguards?
Yes. It explains what counts as a deprivation of liberty, the acid test from the Cheshire West judgment, how the Safeguards work in care homes and hospitals, who applies and who authorises, and what to do if you think someone in your care may be deprived of their liberty without authorisation. It also explains the planned Liberty Protection Safeguards and that they are not yet in force.
Does the Mental Capacity Act apply in Scotland and Northern Ireland?
No. The Act applies in England and Wales. Scotland has the Adults with Incapacity (Scotland) Act 2000 and Northern Ireland has the Mental Capacity Act (Northern Ireland) 2016, which is being brought into force in stages. The principles of assuming capacity and acting in a person's interests are similar, but the procedures differ, and this course is written for England and Wales.
Does Lift College's certificate count towards my CPD?
Yes. The course is 2 hours of learning and the certificate records the hours, the completion date and a recommended refresh date 3 years on. It is a CPD certificate issued by Lift College, with a unique number and a verification link. You can log the hours in your CPD record and show the certificate at your supervision or inspection.
